Radiological Society of North America Image License
Introduction Authors whose manuscripts are accepted for publication in Radiology [RadioGraphics] will receive from RSNA a license for use of their images. This license extends for the full term of the copyright and allows authors to use and sublicense their images to others without requesting permission from RSNA. If authors sublicense their images to commercial parties, they are required to notify the RSNA but need not request RSNA's permission. Each corresponding author will receive his or her image license after the manuscript is accepted for publication and sent to the RSNA Publications Department for processing. Please note that this license is for images (defined as radiologic images, artwork, and related captions) but not for other elements of the accepted manuscript (ie, text, graphs, tables, software). Radiological Society of North America Image License AgreementThis Agreement is entered into on this _______ day of _____________, 200__, by and between the Radiological Society of North America, Inc., an Illinois not-for-profit corporation (the "Society") and ___________________________ (the "Licensee"). Background The Society has received from all of the authors a full assignment of copyright in certain material which is to be published by the Society in one of its scientific journals and/or in connection with other educational activities of the Society. The Licensee is the author, or one of the authors, of that copyrighted material and wishes to obtain a license to make certain use of parts of that material separate and apart from publication by the Society; and the Society wishes to cooperate by granting such a license. Terms of License 1. Grant of License The Society hereby grants to the Licensee a non-exclusive, royalty-free license to reproduce, display and distribute, in any form or medium (including but not limited to electronic form), all or any part of the images (including artwork, radiographic images, and related captions -- hereinafter referred to as the "Images"), but not the other elements (such as text, charts, graphs, tables and software), included in the work which is described in Section 2, below (hereinafter referred to as the "Work"). However, those license rights shall be subject to the following limitations and conditions: (a) The Licensee, and any other co-author of the Work to whom the Licensee grants a sublicense with respect to the Images, may directly reproduce, display or distribute the Images in a net income-generating activity, in addition to using the Images for teaching and scholarly purposes; but neither the Licensee nor any such sublicensee is permitted to assign or sublicense any rights in the Images to any other party except in accordance with Section 4, below. |
(b) Each copy of the Images, or of any excerpt from the Images, displayed or distributed by the Licensee or any assignee or sublicensee from the Licensee (including but not limited to any dissemination in electronic form) shall include (i) a clearly legible acknowledgment that the Images are being reproduced, displayed and/or distributed with the permission of the Society as the copyright owner and (ii) a complete citation of the original source of publication. 2. Description of the Work VERSION ONE [For journal manuscript] The Work consists of all of the text, images and captions, and any charts, graphs, tables, software, and other elements included in a manuscript entitled "_________________________," which was submitted to the Society in _____________, 20_____, for possible publication in _____________________. VERSION TWO [For educational course materials] The Work consists of all of the text, images and captions, and any charts, graphs, tables, software, audio recordings, video recordings, and other elements included in materials entitled "______________________," which were submitted to the Society in ___________, 20_____, for use in educational programs presented by the Society.
3. Term of License (a) Subject to paragraph (b), below, this Agreement and the license granted hereby shall be effective from the date hereof and shall remain in effect throughout the full term of copyright protection for the Work. (b) In the event of a material breach by the Licensee of any obligation or restriction under this Agreement, the Society may terminate this Agreement, and the license granted hereby, by giving written notice of such termination to the Licensee. (c) Upon any termination of this Agreement pursuant to paragraph (b), above, all rights granted to the Licensee under this Agreement (including but not limited to all such rights which may have been assigned or sublicensed by the Licensee) shall revert to the Society. 4. Assignment/Sublicensing The Licensee may assign or sublicense to one or more other parties the right to exercise the license granted by this Agreement; provided, however, that any such assignment or sublicensing to a party other than a co-author of the Work must be in writing, and a copy of the assignment or sublicense must be delivered to the Society prior to the effective date of such assignment or sublicense. 5. Notices All notices or other communications hereunder shall be in writing and shall be given to the other party by hand delivery, by commercial courier, or by registered or certified mail, return receipt requested, postage prepaid, addressed as follows: | If to the Licensee: | ____________________ ____________________ ____________________ |

6. Governing Law This Agreement shall be governed by and construed according to the laws of the State of Illinois, without regard to the choice of law provisions included in such laws.
